By using the Service, you agree to these Terms.
2. Use of the Service
You agree to use the Service in compliance with applicable laws.
You must not:
- misuse or exploit the Service
- interfere with its operation
- upload unlawful or infringing content
We may suspend or terminate access if you violate these Terms.
3. Accounts
You are responsible for your account and credentials.
We offer free and paid subscription plans.
You may delete your account at any time.
Backups may be retained for up to 30 days.
4. User Content
You retain ownership of your content.
You grant us the right to store and process your content to operate the Service.
You confirm that you have the rights to upload your content.
5. AI Content
The Service may generate AI-based content.
Such content may be inaccurate or incomplete and is provided for informational purposes only.
You are responsible for verifying any AI-generated content.
6. Data Import
The Service may process imported data (e.g. CSV files or images).
We do not guarantee accuracy or completeness.
You are responsible for reviewing imported data.
7. Intellectual Property
All rights in the Service remain with OhMyCellar! or its licensors.
You may not copy or exploit the Service beyond what is permitted by law.
8. Payments
Paid features are billed via Stripe.
- Subscriptions renew automatically unless cancelled
- Prices may change for future billing periods
- Payments are non-refundable unless required by law
9. Availability
We may modify or discontinue the Service at any time.
We do not guarantee uninterrupted availability.
10. Liability
To the extent permitted by law, we are not liable for indirect damages or loss of data.
Liability is limited to the amount paid in the 12 months before the claim.
This does not apply in cases of intent, gross negligence, or where liability is required by law.
11. Changes
We may update these Terms at any time.
12. Governing Law
German law applies. Where legally permissible, the place of jurisdiction is Berlin, Germany.
13. Miscellaneous
If any provision is invalid, the remaining provisions remain in effect. Mandatory statutory provisions remain unaffected.
